GENERAL TERMS AND CONDITIONS FOR USE
OF THE LEGENDRE CONNECT MOBILE APP

The Legendre Connect mobile app allows its user to access news from the LEGENDRE GROUP. This information tool allows them to:
•access Group news
•retrieve all issues of the company ’s internal magazine
•centralise access to the various internal apps (client messaging service, CSE platforms, mutual insurance etc.)
•retrieve all the practical info regarding Group worksites (analytical code, list of internal and external contacts, location, state of progress etc.)
•plan an itinerary to a worksite from their mobile phone.
This app is a practical information tool and digital directory for all company colleagues. It is also an app open to anyone wishing to obtain information regarding the company or who have to visit one of the Group ’s worksites.
The purpose of these general terms and conditions of use (hereafter “GTC ”) of the Legendre Connect mobile app is to regulate their use by the user and to inform the latter regarding the applicable legal and regulatory context.
These GTCs apply to all users of the Legendre Connect mobile app as soon as they input their details in order to create an access account.
ARTICLE 1 - LEGAL NOTICES
ARTICLE 2 - PROTECTION OF PERSONAL DATA
The protection of privacy is of great concern to the LEGENDRE GROUP.
Personal data (hereafter “data ”) is defined by law as “Any information relating to an identified physical person or anyone who could be identified, directly or indirectly, by reference to an identification number or to one or several elements specific to him/her ”.
The processing of your data is subject to compliance with the provisions of Law 78-17 of 6 January 1978 amended (“the Data Protection Act ”) and European Regulation No. 2016/679 of 27 April 2016 on the protection of personal data, known as “GDPR ”or any other legislative or regulatory act amending them.
The purpose of this article is to explain to you clearly and simply - as a user of our mobile app - how we collect, use and store your data.
2.1 The Processing Manager
The LEGENDRE GROUP, a joint-stock company with a capital of 10,065,600 euros, whose headquarters are located at 5, rue Louis-Jacques Daguerre - 35136 SAINT JACQUES DE LA LANDE and recorded in the Rennes Trade and Companies Register under No. 440 919 777 (hereafter the “Processing Manager ”) is responsible for processing your data.
2.2. The Data Protection Officer
The LEGENDRE GROUP has designated a data protection officer (hereafter the “DPO ”). It is the task of the latter, in particular, to notify and advise the processing manager on all questions relating to data protection. He/she monitors compliance with the data protection regulations. He/she is also the contact for the Commission nationale de l 'informatique et des libert és (the “CNIL ”) [the French National Data Protection Commission], the monitoring authority, for all questions relating to data management.

2.3. Purposes
The purpose of the data processing carried out by the LEGENDRE GROUP by means of its mobile app is as follows:
Some data is indispensable to the LEGENDRE GROUP in order to fulfil the purposes described above. If you fail to complete these fields, your access to the mobile app may be refused. The other fields identified by an asterisk (*) are optional and are used to improve your identification as a mobile app user.
2.4. Legal basis
The legal basis on which we rely for the processing of your data is that of contractual performance for the creation of your access account and authentication and that of consent for georeferencing.
2.5. Data recipients
According to the purposes described above, the data collected by the LEGENDRE GROUP may be sent to employees of the Legendre Group ’s Marketing and Computing Departments who are responsible for managing the mobile app.
2.6. Data retention period
Data is retained for the period necessary for the realisation of the various purposes described above.
Data is deleted following the occurrence of one of the following events:
It is specified here that should an employee user of the mobile app no longer be a member of staff, his/her access will systematically be changed to guest access.
2.7. Existence of automated decision-making
When you input your data, it is automatically checked against the information the LEGENDRE GROUP already holds in order to identify you as an employee.
If the information communicated by the automatic check carried out is not recognised, the access created in the mobile app will be that of a guest.
2.8. What are your rights?
Within the context of the processing of your data, you have a right of access, correction, a right to erase and a right to the limitation of data processing.

ARTICLE 3 - INTELLECTUAL PROPERTY
All intellectual property rights relating both to the structure and the contents of the mobile app are reserved. These elements are the property of the LEGENDRE GROUP. They are made available to users ex gracia for the sole use of the mobile app within the context of the normal use of its features.
Users undertake not to modify these elements in any way whatsoever. Any reproduction, representation, publication, transmission, use, modification or extraction of all or part of the elements of the mobile app, in any way whatsoever, made without the prior written authorisation of the LEGENDRE GROUP, is illegal.
ARTICLE 4 - HYPERTEXT LINKS
The mobile app may contain hypertext links redirecting users to websites and/or apps operated by third parties. These links are supplied for information only.
The LEGENDRE GROUP does not have any control over these websites and/or applications and does not accept any liability regarding access to their content.
In particular, the LEGENDRE GROUP invites mobile app users to enquire about the policy of these websites and/or applications regarding the protection of personal data.
ARTICLE 5 - LIABILITY
The user shall be held liable for any abnormal or illegal use disrupting the proper functioning of the mobile app.
The LEGENDRE GROUP can only be held liable for direct losses suffered by the user arising from a failure to its contractual obligations as defined in these Terms and Conditions.
The LEGENDRE GROUP cannot be held liable in cases of:
The LEGENDRE GROUP does not accept any liability regarding the content of comment fields, for which the user is fully liable.
ARTICLE 6 - MODIFICATION OF THESE TERMS AND CONDITIONS
The LEGENDRE GROUP reserves the right to modify or interrupt all or part of the access to the app at any time.
ARTICLE 7 - NON-WAIVER
The fact that the LEGENDRE GROUP does not prevail upon any one of the provisions in these Terms and Conditions of Use at a certain time shall not be interpreted as a waiver to prevail upon any one of these conditions at a later date.
ARTICLE 8 - PARTIAL NULLITY
If part of these Terms and Conditions should be unenforceable for any reason whatsoever, the provisions in question shall be deemed to be unwritten, without bringing into question the validity of the other provisions, which shall continue to apply.
ARTICLE 9 - APPLICABLE LAW
These Terms and Conditions of Use are subject to French law.
ARTICLE 10 - JURISDICTION
In the case of difficulties in using the app, the user should first and foremost contact the LEGENDRE GROUP in order to reach a friendly settlement.
In the case of failure to reach a friendly settlement, the competent courts shall be those located within the jurisdiction of the RENNES Court of Appeal.
